Wyndham Terms and Conditions

1. Scope of Legal Services

1.1  We will provide you with legal services and advice as agreed upon in the initial consultation, engagement letter or costs agreement. The scope of our work will be limited to the specific matter(s) described therein unless otherwise agreed in writing, and any additional services may be subject to a variation or separate agreement.

2. Fees and Billing

2.1. Our professional fees are calculated in accordance with the Legal Profession Uniform Law and other applicable regulations.
2.2. You will be provided with a costs disclosure and agreement outlining our fee structure, and estimated total legal costs.
2.3. Disbursements and out-of-pocket expenses (e.g. court filing fees, travel, external invoices) will be billed separately and are payable by you.
2.4. Invoices will be issued intermittently, and payment is due within 14 days unless otherwise agreed.

3. Client Responsibilities

You agree to:
3.1. Provide us with accurate, complete, and timely instructions;
3.2. Respond promptly to communications and requests for documentation;
3.3. Cooperate fully in the conduct of your matter; and
3.4. Make all payments as agreed and on time.
 

4. Confidentiality

All communications are confidential and will not be disclosed without your consent, except as required by law.

5. Conflicts of Interest

We take all reasonable measures to avoid conflicts of interest. If a conflict arises, we will notify you immediately and take appropriate steps.

6. Limitation of Liability

Our liability is limited by a scheme approved under Professional Standards Legislation.

7. Termination of Services

7.1. You may terminate the engagement by giving reasonable notice in writing, and you will be required to pay for all legal work performed and disbursements incurred up to the date of termination. 7.2. We may cease to act for you if there is a breakdown in trust, non-payment of fees, failure to provide instructions, or for any other reason permitted by law or professional conduct rules.

8. Document Retention

We are required to retain legal files for a minimum of seven (7) years after the closure of a matter unless otherwise agreed.

9. Jurisdiction

These Terms and Conditions are governed by the laws of the State of Victoria, Australia.

10. Entire Agreement

These Terms and Conditions, together with any engagement letter and costs agreement, form the entire agreement between us.

11. Acknowledgement

By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
